Toxic Materials

Some older apartment buildings contain asbestos building materials and some were painted with lead-based paint. Lead and asbestos are toxic. If your apartment complex is in this category, you may be required by law to notify prospective tenants that the apartment building contains lead-based paint or asbestos or both, as appropriate.

If repair work disturbs lead-based paint or asbestos, you must ensure that employees or vendors are appropriately licensed to work with the toxic material that is disturbed. Generally, toxic building materials must be sealed and transported by a licensed contractor, and the waste must be consigned to a waste facility licensed to accept the specific toxic material.

The apartment complex or apartment management company must maintain auditable records of the disposal.
